Lan issue with Fatal1ty Z97 Killer

Just upgraded to Spectrum Ultra 300mbps yet I cannot get even close to those speeds. Had a person from Spectrum here yestereday and they upgraded my Modem to Router and even every cable I had was exchanged. Yet I went from 50 to 60mbps to 170mbps and should be hitting 400mbps or more with no success. Spectrum is telling me its the LAN port but I have run the most recent files and still nothing. Can the Antheros Lan be causing this or is there more required to fix this issue?

What is spectrum telling you?. Your Lan Port ios broken?
What Cables did he use for Replacement.
Is you Network setup properly?
Are u using the Proper network drivers?

Charter/Spectrum changed every fastcat5 cable and replaced the modem and the Router. The problem is I should be getting the 300mbps using their Spectrum Ultra Internet, Yet when I run the speed tests I can only hit 170mpbs tops. I ran the most recent Lan drivers for Windows 7 Ultimate and still get no change. Originaly before they replaced both items it would only hit the high 30s. still Charter is saying that my Lan is not allowing the highest speeds they have but makes no sense as it gave a large increase with the new modem and Router going from 40s to 170s yet why would it stop at those numbers.
As for the network drivers I thought I was but I will have to look them up  as well.

Sounds to me like Spectrum is blaming you for their failure of service

Funny thing is now I updated my motherboard bios and now the speed tests are starting out in the 300s but by the end of the test it drops down to the 50s again? I have no clue why that this speed test has changed so much just because of a Bios Update? it used to be in the 180s and steady now it is starting high and drops low. no clue but think I am gonna get rid of it and go back to the 100mbps which was stable with no other issues. I would drop Spectrum/Charter all together if I had another viable option.
